Licence to Occupy and Use and an Itri Serviced Apartment

Please note: This licence has been written in English. Itri Serviced Apartments take no responsibility for any misinterpretation of the agreement, when read in any other language than English, interpreted by translation software.

Apartment: means the apartment located as specified.

Grantor: means the owner of the apartment granting the licence to the Guest.

Grantee: means the Guest to whom the Grantor has agreed to grant the licence to use the Apartment.

Deposit: means the payment of the amount specified.

Keys: means keys or any other type of security device allowing the Guest to access the apartment.

Occupation period: means the period for which the apartment is booked.

Licence fee: means the total amount payable to book the apartment for the period of occupation.

Permissible use: means to use and occupy the apartment as a guest.

The terms and conditions of this licence apply to reservations whether made in person, by phone or by any electronic means and the agreement for the Grantee to occupy and use the apartment.

A non refundable booking deposit being 20% of total accommodation amount is payable to secure a booking. The remaining 80% is payable at least fourteen and within 3 days of arrival.If this payment is not received within this period, the Grantor reserves the right to cancel the reservation.

Please note:

Rates are for self catering and self cleaning the apartment.

The accommodation will be prepared with fresh linen, cleaned and tidied before arrival.

Water, gas and electricity are included in the rent.

The Grantee must pay to the Grantor €35 for Cleaning the apartment at the end of your stay plus a Security Deposit bond of €60. These amounts must be paid on arrival and in cash before possession of keys will be obtained.

The security deposit will be refunded subject to our final inspection prior to the Grantee's departure.Should damage or loss of property be observed, the security deposit will be adjusted accordingly and any refund transferred at the Grantee direction.

The Grantor reserves the right to deduct from the security deposit bond, the cost of repairing any damage to the apartment during the Grantee’s stay in the apartment and any inventory items that cannot be immediately identified will be charged as a replacement to the Grantee.

If keys to the Property are lost, the Grantee will be responsible for the cost of changing the locks and the cutting of new sets of keys.

Minimum stays - 3 nights.

In the event of minor faults and/or malfunctions of appliances or inclusions, there is no obligation from The Grantor to compensate or discount.

The Grantee agrees to leave the premises and the furniture, in a clean and tidy state of repair and condition and in accordance with the provisions of this Agreement.

The apartment must not be occupied by more than the number of persons shown on the application form during the period booked.

The apartment must not be used other than the permissible use.

The Grantee agrees to vacate the apartment at the end of the occupation period.

No pets of any kind are allowed in the apartment. Violation of this clause will terminate this agreement with no refund of money paid or due under this agreement.

The Grantee agrees that no occupier or visitor to the apartment will smoke within the apartment.

The Grantee agrees to notify the Grantor of any damage to the apartment and or its contents and any accidents that occur within the apartment during the occupation period. All damage that occurs within the apartment is the responsibility of the Grantee. The Grantee will be responsible for the cost of the damage caused or the cost or repairs or cleaning occasioned by such damage and or accident occurring within the apartment.

The Grantee agrees to dispose of all garbage and waste in accordance with the instructions in the apartment.

Except in the case of death or personal injury for which the Grantor may be liable under applicable law or as expressed in this agreement the Grantor shall not be liable to the Grantee by reason of innocent representation or any implied warranty, condition or other term, or any duty at common law for any loss of profit, opportunity or any indirect, special or consequential loss, damage, costs, expenses or other claims however caused which arise out of or in connection with the provision of this accommodation by the Grantor to the Grantee.

The Grantee agrees not to make any modifications or alternations to the apartment or its contents.

This agreement does not confer on the Grantee any estate or interest in the apartment, the land it occupies or any part of it.

The Grantee agrees not to play or permit to be played in the premises, any musical instrument or sound production equipment, between 11pm and 8am or so as to be audible outside the premises.

The Grantee agrees to permit The Grantor or their agents’ access to the Premises to deal with any maintenance or security issues.

The Grantee agrees to enter car park at their own risk.

Only the named Guarantees are permitted to use or stay in the property.  The Grantor or their representative have a right at all times to refuse access to the property for people who are not members of the party.

In the event that the owner of representative has a legitimate cause for concern or if the guest has not been seen nor been able to be contacted over a period of time, the apartment may be entered by a personnel representative to ensure the safety and comfort of all guests or residents is in order.

The Grantee is responsible for keeping the Property secure during their stay and will be responsible for any theft or damage to the Grantors  Property due to neglect in this area. It is important to ensure all windows and doors are closed and locked prior to departing the Property.

It is the responsibility of the Grantee to ensure that their personal possessions are insured. The Grantor cannot accept any liability for theft of, loss of or damage to personal possessions.

The Grantor also recommend arranging adequate travel insurance for cover in case of cancellation.

If requested The Grantor will endeavour to recover and return items of value inadvertently left at the Property at the Grantees expense. The Grantor take absolutely no responsibility for the recovery or return. Items found will be held for claiming for a maximum of 1 week and if not claimed will be disposed of.

Your Accommodation: The Grantee may arrive at the accommodation any time between 14:00 hours and 18:00 hours on the first date of the booking. The Grantee must leave by11:00 hours on the departure date.If the arrival will be delayed, The Grantee must contact the person whose details are given on the booking confirmation so that alternative arrangements can be made. If The Grantee fails to do so, The Grantee may not be able to gain access to the property. If The Grantee fails to arrive by midday on the day after the arrival date and the Grantee do not advise the contact of their anticipated late arrival, the Grantor may treat the booking as having been cancelled by the Grantee, then the Grantor shall be entitled to treat the booking as being cancelled by you and the Grantor shall be under no obligation to refund the Grantee for fees already paid to the Grantor. The cancellation policy shall apply. (See below)

Cancellation Policy:

The Grantee can cancel the booking anytime. Cancellation must be communicated to The Grantor in writing and takes effect from the date received by The Grantor. In the event of cancellation then the following charges become applicable.

The Grantee can cancel up to 2 weeks and less than 3 days prior to arrival. The Grantee will receive a refund of 50% of the balance; otherwise no refund will be made.

In case of a split payment, the booking deposit is always non-refundable.

Cancellation by us:

If the Grantor is forced to cancel the property rental for any reason that makes the property unfit for rental the Grantor will give a full refund, all monies paid. Please note that the Grantor is not liable for any consequential loss or incidental expenditure resulting from the cancellation of the holiday.

Eviction of a Grantee:

 A Grantee is subject to such eviction should the following (but not limited to) occur;

Intoxication and unsavoury behaviour.

 Overcrowding - when the number of persons in the apartment exceeds capacity.

 Physical or verbal assault towards personnel representative, residents or other guests. 

 Wilful damage to the Apartments property.

 Any incident for which the police need to be called onto the premises.

 Any behaviour posing a safety threat to others.

 Ignoring advice to reduce excessive noise (music or other noise).

 Throwing of objects over the apartment balconies or from windows.

 Photo identification:

Valid photo identification (ID) matching the names of the Grantee’s within the reservation must be presented at time of check-in/arrival. This is required in order to verify the Grantee’s identity for security purposes.A valid driver's license, identity card, or an international passport are all acceptable forms of photo identification.This ID may be copied and securely stored as record that The Grantor have verified who you are. As per this privacy policy, any personal information contained on the collected identification will not be on-sold; will be securely stored and carefully disposed of at the end of its usefulness.

Indemnity
No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond the Grantor’s control. No responsibility is taken for Grantee’s personal property left on or near the premises. It is recommended that Grantee take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during travel period.

Provisions and Declarations:

This agreement is made on the basis that the premises are to be occupied by the guest for a holiday accommodation purposes.

The terms and conditions of the Agreement become valid upon written confirmation by The Grantor of acceptance of the holiday letting period for the agreed letting period.
